![]() Level: 4 CS Original | I've started to debate truthers and Austrians on the internet. I was recently told by an Austrian unemployment insurance was unconstitutional. How do you respond to that argument? | |||||

![]() Level: 1 CS Original | If unemployment insurance is indeed unconstitutional, he should have no problem taking the issue to the courts. I believe unemployment insurance is issued by the States and not the federal government (I could be mistaken), so a state supreme court could easily strike the program down if it is unconstitutional. But I think the best reply would be that lawyers much more intelligent than some unemployed amateur Austrian economist created the policy which is now in place. And if there is anything that lawyers are good at it is working within the law (in very clever ways)to create policy and programs that can survive constitutional scrutiny. | |||||

![]() Genuine American Monster Level: 70 CS Original | I have a few different responses to Constitutional fundamentalists: 1) Ask them if they're a Constitutional lawyer. They usually either go away or start insulting me by the time I get to the third. Another good avenue is to request they explain the purpose of the Supreme Court if the Constitution was only intended to be interpreted one way for eternity. | |||||
